Nachträge zu Bauwerkverträgen erlangen immer größere praktische Bedeutung. Aus Sicht des Auftragnehmers bedeuten sie zwar einen höheren baulichen Aufwand, aber in der Regel auch einen höheren als den ursprünglich vereinbarten Werklohn. Aus Sicht des Auftraggebers sind Nachträge immer mit Mehrkosten verbunden. Neben höheren Baukosten sind dies Personal- und Sachkosten, die durch die Nachtragsverhandlungen verursacht werden. Auftraggeber versuchen daher, Verträge so zu gestalten, dass Nachträge nicht entstehen können. Dies führte dazu, dass sich der Schwerpunkt in Bauwerkverträgen von der Leistungsbeschreibung auf juristische Klauseln verlagert hat. Die Anzahl der gerichtlichen Auseinandersetzungen, in denen es um die Auslegung dieser immer komplexeren Vertragswerke geht, hat in den letzten Jahren allerdings nicht ab-, sondern zugenommen. Die gesetzlichen Bestimmungen zum Bauwerkvertrag im ABGB sind grundsätzlich dispositiv. Nicht-öffentliche Auftraggeber sind gesetzlich auch nicht zur Anwendung der Bauwerkvertragsnormen verpflichtet. Die Rechtsprechung schränkt den vertraglichen Gestaltungsspielraum der Parteien eines Bauwerkvertrages aber erheblich ein. Weichen vertragliche Bestimmungen zu stark vom Gesetz oder einer ÖNORM-Bestimmung ab, werden sie von der Judikatur als sittenwidrig angesehen. Auch nach Vertragsabschluss kann der Auftraggeber das Risiko einer Nachtragsforderung durch eine sorgfältige Bauleitung und aktives Claim-Management verringern. Die im angloamerikanischen Bereich bestehenden alternativen Vertrags- und Streitbeilegungsmodelle finden langsam Eingang in die österreichische Rechtslage und die Vertragsgestaltung.
