Die vorliegende Arbeit beschäftigt sich mit der Bewertung von Zinshäusern im § 18 MRG Verfahren. Beginnend mit dem Kapitel Grundlagen wird der Begriff Zins- haus erläutert. Im Zuge der 'Mietrechtlichen Aspekte' wurden einzelne Gesichts- punkte des MRG, welche auf die Bewertung von Zinshäusern (im Allgemeinen so- wie im § 18 MRG Verfahren) wesentlich erschienen, herausgearbeitet. Dies vor al- lem in Hinblick darauf, dass mit diesen Bestimmungen direkt auf das Potential und den Ertrag der Liegenschaft eingewirkt wird. Darauf aufbauend wurden die Beson- derheiten des § 18 MRG Verfahren näher beleuchtet. Das §18 MRG Verfahren stellt eine Möglichkeit dar, Erhaltungs- und Verbesse- rungsmaßnahmen sowie Reparaturen in Zinshäusern trotz fehlender Mietzinsreser- ven vorzunehmen. Im Zuge der Bewertung ist ein grundsätzliches Verständnis des Verfahrens zur entsprechenden Einpreisung der Besonderheiten wichtig. Je nach- dem in welchem Stadium sich das Verfahren gerade befindet, sind die Chancen und Risiken zu valorisieren. Das Kapitel §18 MRG Verfahren stellt die Grundzüge und Voraussetzungen, die Arbeiten und den Ablauf sowie die Förderungsmöglichkeiten kurz dar, wobei das Ziel der Ausführungen die Herausarbeitung der für die Bewer- tung wesentlichen Punkte ist und nicht die detaillierte Antragstellung und Herausfor- derungen damit. Das darauffolgende Kapitel ist der Methodik und den Verfahren der Bewertung ge- widmet. Es werden die Rechtsquellen, der Wertbegriff sowie die Bewertungsverfah- ren dargestellt, die im Zusammenhang mit Bewertung eines Zinshauses wesentli- chen Einfluss haben. Es stellt die Basis für die nachfolgenden Kapitel dar, die sich mit der Problematik der Bewertung des (ertragslosen) Zinshauses und dann im Speziellen mit der Besonderheit der Bewertung während des § 18 MRG-Verfahrens auseinandersetzen. In diesen beiden Kapiteln werden neben den Spezifika des er- tragslosen Zinshauses und der Sonderformen des Zinshauses im §18 MRG Verfah- ren (mit und ohne Förderung) anhand von vier Bewertungsarten die Grenzen der Bewertung mit diesen, die Herausforderungen die im Zuge einer Bewertung auftre- ten sowie die Lösungsvorschläge erarbeitet. Das Ertragswertverfahren (ohne over-/underrent) liefert nur passende Ergebnisse, wenn es für ein zu Marktmieten vollvermietetes Zinshaus in guter Lage angewendet wird. Verfahren die auf Vergleichswerte Bezug nehmen, haben in diesem spezifi- schen Bereich der Bewertung oft das Problem der Beschaffung vergleichbarer Da- ten. Die Methode 40 Jahre Turnaround stellt einen pragmatischen praxisrelevanten Zugang dar. Als das für den Bewertungsvorgang brauchbarste Verfahren stellte sich die Investment Method (mit ihren Ausprägungsformen Term and Reversion oder Layer Method) dar.
