Die florierenden Entwicklungen in der türkischen Bauwirtschaft sowohl bei öffentlichen als auch bei privaten Bauvorhaben machen die Türkei zu einem attraktiven Partner für die europäischen Bauunternehmen.<br />Darüber hinaus eröffnet ihr die Anpassung an die europäischen Richtlinien mit den laufenden EU-Beitrittsverhandlungen mehr Möglichkeiten, um ein wichtiger Akteur in der Baubranche zu werden.<br />Deshalb besteht das Ziel dieser Diplomarbeit darin, einen Überblick über die Marktsituation und die Rechtsvorschriften im türkischen Bausektor zu ermöglichen. Dies soll durch die Betrachtung von zwei türkischen Rechtsvorschriften, das "Öffentliche Vergabegesetz" (Kamu Ihale Kanunu) und die "Allgemeine Bestimmungen für Bauleistungen" (Yapim Isleri Genel Sartnamesi), erreicht werden. Die Untersuchung dieser Rechtsvorschriften ist in dieser Arbeit von hoher Wichtigkeit, da sie seit 2003 die gültigen Regulierungen bei öffentlichen Bauvorhaben darstellen.<br />Zusätzlich werden auch wichtige Themenbereiche wie die türkischen Gesellschaftsformen sowie die Besteuerung erläutert. Das zweite Ziel dieser Arbeit ist der Vergleich dieser Erkenntnisse mit den aktuellen österreichischen Pendants, das Bundesvergabegesetz 2006 und die ÖNORM B 2110. Dieser Vergleich ist aufgrund der Beteiligung von österreichischen Unternehmen an öffentlichen Bauprojekten in der Türkei, vor allem an der Errichtung von Wasserkraftwerken, nicht unbedeutend. Letztendlich soll diese Arbeit einen Einblick in die türkische Bauwirtschaft durch die Bewertung der wichtigsten Punkte in den Bauverträgen und im Vergaberecht in der Türkei und in Österreich gewähren.<br />

The booming developments in the Turkish construction industry in private and public projects make Turkey an attractive partner for the European contracting business. In addition, the harmonisation to the European directives with the ongoing EU-accession-negotiations creates more opportunities to become an important construction industry player.<br />Therefore this Master Thesis aim is to provide an overview of the market situation and legislation in the construction sector in Turkey. This will be done by the use of two Turkish legal rules known as, the "Public Procurement Law" (Kamu Ihale Kanunu) and the "General conditions of contract for works of building and civil engineering construction" (Yapim Isleri Genel Sartnamesi). These rules are important to consider in this Thesis since they act as valid regulations in public constructions projects since 2003. In addition, issues such as legal forms for Turkish companies and taxation will be discussed. The second aim of this Thesis is to compare these findings with the current Austrian counterparts, Bundesvergabegesetz 2006 und ÖNORM B 2110. This comparison is important to take into account since Austrian companies participate in public construction projects in Turkey, by engaging mainly in the construction of hydroelectric power plants. In the end, this Thesis will be able to provide insights for the Turkish construction industry, by assessing the main points of the construction contracts and procurement laws in Turkey and Austria.
