In der vorliegenden Arbeit werden rechtliche Gesichtspunkte, insbesondere haftungsrechtliche Folgen, einer Liegenschaftsdereliktion erörtert und dabei die Unterschiede zwischen dem zivilrechtlichen und dem öffentlich-rechtlichen Haftungssystem zugrunde gelegt. Es werden für den Bereich des Zivilrechts, unter Berücksichtigung der höchstgerichtlichen Rechtsprechung des OGH, neben den allgemeinen Verkehrssicherungspflichten und jenen nach bestehenden Sonderhaftungsnormen (§§ 1319 und 1319a ABGB) va Implikationen für die Beurteilung nachbarrechtlicher Ansprüche nach den §§ 364 f ABGB dargestellt. Für den Bereich des öffentlichen Rechts werden Verantwortlichkeiten des Liegenschaftseigentümers anhand der positivierten Normen und der höchstgerichtliche Rechtsprechung des VwGH, fokussiert auf die zentralen umweltrechtlichen Bestimmungen (WRG, GewO etc) und ergänzt durch einen Überblick über die Regierungsvorlage zum B- UHG, untersucht. Im Rahmen von vier ausgewählten Fallbeispielen werden nicht nur die erwähnten zivil- und öffentlich-rechtlichen Bestimmungen samt der dazu ergangenen höchstgerichtlichen Judikatur erörtert, sondern auch iZm Dereliktionen interessierende mietrechtliche und denkmalschutzrechtliche Bestimmungen ebenso wie Bestimmungen des ForstG und des AlSaG in der gebotenen Kürze erörtert.
