Abstract:
Witterungsverhältnisse spielen in jeder Bauausführung eine bedeutende Rolle. Sie haben maßgeblichen Einfluss auf den Baufortschritt und damit unmittelbar auf den wirtschaftlichen Erfolges eines Bauprojektes. Die Mehrzahl an Bauverträge in Österreich werden auf Grundlage der ÖNORM B 2110 bzw. ÖNORM B 2118 geschlossen. Die Normen teilen das Risiko infolge von Witterung mit dem zum Zeitpunkt der Angebotsabgabe zu rechnen war generell dem Auftragnehmer zu. Mögli-che Bauablaufstörungen sind daher bereits in der Kalkulation mit einzubeziehen. Das Risiko außergewöhnlicher Witterungsverhältnisse wird hingegen dem Auftraggeber zu-geordnet. Konnte der Auftragnehmer zum Zeitpunkt der Angebotsabgabe nicht mit den tat-sächlichen Verhältnissen rechnen, sind diese Witterungsverhältnisse definitionsgemäß au-ßergewöhnlich und deren Folgen somit vom Auftraggeber zu tragen. Die genaue Abgrenzung eines gewöhnlichen zu einem außergewöhnlichen Ereignis wird von den aktuellen Normen unterschiedlich gehandhabt. Während die ÖNORM B 2110 lediglich auf ein "10-jährliches Ereignis" verweis, gibt die ÖNORM B 2118 exakt definierte Verhältnisse vor, ab welchen ein Ereignis als außergewöhn-lich zu charakterisieren ist. Darüber hinaus wurden bereits alternative Bewertungsmethoden (Innsbrucker Modell, Methode nach Spranz, Methode nach Fetzner) entwickelt, welche die Abgrenzung von Witterungsverhältnissen auf anderen Wegen ermöglichen. Die vorliegende Arbeit beschäftigt sich mit den unterschiedlichen Definitionen von außerge-wöhnlicher Witterung und deren Berechnungsansätzen. In einem theoretischen Teil werden zunächst die Modelle vorgestellt und in einer Gegenüberstellung kritisch beurteilt. Der praktische Teil dieser Arbeit besteht aus der Auswertung von Witterungsdaten des Win-terhalbjahres 2005/06 nach den vorgestellten Modellen. Die Auswertung zeigt deutlich wel-ches Modell das Risiko infolge Witterung tendenziell dem Auftraggeber respektive dem Auf-tragnehmer zuteilt. Darüber hinaus werden die Modelle hinsichtlich ihrer Praxisrelevanz un-tersucht und mögliche Schwachpunkte aufgezeigt.
Meteorological conditions play a significant role in every execution of construction work. They have a significant stake in the construction progress and therefore impact directly the eco-nomical success of every construction project. The majority of construction contracts in Austria are conducted upon the basis of ÖNORM B 2110 & ÖNORM B 2118. These norms allocate the risks caused by meteorological condi-tions, with which the primary calculations were done at the time of the submittal of quotation, to the agent. Possible construction cycle disturbances are therefore to be included in the primary calculations. The risk of extraordinary meteorological conditions on the other hand is allocated to the prin-cipal. If the agent was not able to calculate with the actual conditions at the time of the sub-mittal of quotation, the meteorological conditions are then to be called by definition 'extraor-dinary' and therefore allocated to the principal. The exact differentiation of an ordinary and extraordinary event is treated differently by the actual norms. While ÖNORM B 2110 simply refers to a 10-year-event, ÖNORM B 2118 clearly posts exactly defined conditions to which an event can be categorized as 'extraordinary'. Furthermore alternative evaluation methods were developed ('Innsbruck model', 'Spranz's method', 'Fetzner's method') which make a differentiation of meteorological conditions in other ways possible. This degree dissertation deals with the different definitions of extraordinary meteorological conditions and their calculation approaches. In the theoretical part models are at first intro-duced and in comparison critically evaluated. The practical part of this dissertation consists of the analysis of meteorological condition data during the 6-month winter period of 2005/06 based on the above mentioned models. The analysis clearly shows which model allocates which risks caused by meteorological condi-tions to either the principal or the agent. Furthermore each model is analyzed by its practical relevance to also show possible weaknesses.
