Abstract:
Die Grundstücks- und Wohnungspreise befanden sich im Jahr 2022 in Österreich auf Rekordniveau. Zwar ist dabei eine regionale Differenzierung erkennbar, vor allem das Rheintal in Vorarlberg zählt jedoch zu den teuersten Regionen in Österreich. Dies liegt zu einem nicht geringen Teil daran, dass gewidmete Bauflächen häufig nicht genutzt, sondern aus diversen Gründen gehortet wird. Ein Instrument, mit dem diese Herausforderungen adressiert werden können, ist die Aktive Bodenpolitik. Mit der Aktiven Bodenpolitik, bei der Grundstücke angekauft, strategisch entwickelt und weitergegeben werden, können die Gemeinden direkt selbst tätig werden und Grundstücke der gewünschten Nutzung – beispielsweise für das leistbare Wohnen – zugeführt werden. In der vorliegenden Arbeit wird analysiert, inwiefern sich die Aktive Bodenpolitik tatsächlich zur Bereitstellung von leistbarem Wohnraum eignet. Dafür werden zuerst rechtliche und planungspolitische Hintergründe des Erwerbs von Grundstücken sowie Ausprägungen und Alternativen zu Grundstücken näher beleuchtet. Es folgt ein Aufriss der Kompetenzverteilung im Wohnrecht sowie eine Darstellung der Möglichkeiten, die den Gemeinden zur Bereitstellung leistbaren Wohnraums zur Verfügung stehen. Dazu wurden neben klassischen Literaturrecherchen und einer Analyse der Rechtsgrundlagen Interviews mit Bürgermeistern von fünf Vorarlberger Gemeinden verschiedener Größen geführt. So konnten bewährte Vorgehensweisen, aber auch Schwierigkeiten und Erfolgsfaktoren bei der Bereitstellung von leistbarem Wohnraum mithilfe der Aktiven Bodenpolitik erhoben werden. Daraus folgt schließlich die Ableitung von Handlungsempfehlungen für die Gemeinden.

Land and housing prices in Austria have been at record levels in 2022. Although there are regional differences, Vorarlberg - especially the region Rheintal - is one of the most expensive regions in Austria. One of the causes for this ist the fact that dedicated building areas are often not used, but hoarded.Municipalities can adress this issues on the one hand through sovereign measures and on the other hand through private-sector measures. The former category includes all planning measures of local spatial planning such as zoning and development planning. Private-sector measures include above all contractual land use planning and the implementation of an active land policy of the municipalities. While for most measures the municipalities are dependent on the implementation by other actors, they can act directly within the framework of the active land policy. They can purchase land and real estate and subsequently negottate desired uses with future buyers or develop it themselves. The aim of this thesis is to analyse the processes of the implementation of active land policy by municipalities in Vorarlberg. The legal framework as well as the political motivation for the acquisition of real estate by them are to be examined more closely. In adddition to literature research and an analysis of the legal basis, interviews were conducted with mayors and spatial planners of five Vorarlberg municipalities of varying population sizes. In this way, best practices but also difficulties in the provision of aff ordable housing with the help of active land policy were ascertained. From this, recommendations for action for the municipalities were derived.
