Planung, aber auch Gesetzgebung, Rechtsprechung und im vorliegenden Fall insbesondere Verwaltung befinden sich stets im Spannungsverhältnis zwischen den Schutzbedürfnissen der Umwelt und den gesellschafts-, sozialsowie wirtschaftspolitischen Grundbedürfnissen einer Volkswirtschaft nach Wertschöpfung, Beschäftigung, Wettbewerbsfähigkeit und Wohlstand, um die Lebensqualität der Bürgerinnen und Bürger zu maximieren. An dieser Schnittstelle steht das Instrument der Interessenabwägung und versucht, möglichst wissenschaftlich fundiert und nachvollziehbar, einen Ausgleich zwischen wirtschaftlichen Interessen und Interessen der Umwelt oder bspw des Naturoder Klimaschutzes zu schaffen. Untersuchungsgegenstand dieser Arbeit ist einerseits die formell-rechtliche Regelung der Interessenabwägung in Österreich, aber auch die Grundsätze, Prinzipien oder Ziele von denen diese beeinflusst ist. Konkrete Wirtschaftsinteressen, die konkreten Umweltinteressen entgegenstehen könnten oder konkrete Umweltinteressen, die konkreten Wirtschaftsinteressen entgegenstehen könnten werden detailliert aufgearbeitet und in den Kontext der Rechtsprechung der vergangenen Jahrzehnte gesetzt. Am Schluss der Arbeit stehen qualitative Aussagen zum Ablauf von verwaltungsbehördlichen Abwägungsverfahren, zu deren Stärken und Schwächen sowie abschließend zum Stellenwert der Umwelt, des Klimas und der Natur.

The institutions of planning, legislation, jurisdiction and in this case particularly administration are consistently found in a state of tension between the environmental need for protection and the basic societal, social and economic requirements of the national economy to create value, employment, wealth and sustain competitiveness in order to ensure quality of life for its citizens. The tool of interest assessment sits at this intersection and attempts, as scientifically sound and transparently as possible, to create a balance between economic and environmental interests, as well as interests of nature conservation and climate protection. This thesis will focus on the formal and legal regulations of interest assessment in Austria on the one hand, and the principles and goals that influence it on the other. Concrete economic interests in possible opposition to concrete environmental interests and concrete environmental interests that could stand in opposition to concrete economic interests will then be worked through in detail and put into the context of the relevant jurisdiction from the last decades. Finally, this thesis will provide qualitative statements about the administrative processes of assessment, including their strengths and weaknesses, as well as about the importance of environment, climate and nature. The second section is an evaluation of the protection of environmental media in the process of planning by discussing legislative material of spatial planning law and nature protection law. The main focus will be on the provincial legislation of Vienna, but qualitative comparisons to differing realisations in other federal provinces will be drawn when necessary. In its aim of generating a higher quality of life for citizens, spatial planning is always in conflict between the protective needs of the environment and the socio-political, fundamental market requirements of a national economy, which comprise the demands of added value, employment, competitiveness and prosperity. However, since the quality of the environment has to be conserved for future generations, choosing the degree of protection by way of planning permits and designations is nothing more than a shifting of said quality of life onto future generations. The paradox inherent in these conflicting notions will be focused on further in the last part of this section. This thesis will place special attention on the topics relevance for planning purposes. Contrary to foregrounding the legislative discourse, the goal of this paper is an application-based approach and topical understanding of environmentally relevant legislative material from the viewpoint of the planner.
