Während eines Bauvorhabens sind Beschädigungen an der dem Auftraggeber übergebenen und nicht übergebenen Leistung, sowie an der vorhandenen Bausubstanz kaum vermeidbar. Aus diesem Grund ist es unerlässlich, dass vor der Ausführung vertraglich festgelegt wird, welche Vertragspartei für den Schaden haftet. Ein Bauschaden kann während aber auch nach der Bauausführung unterschiedliche Ursachen haben. So ist ein Schaden an einem Bauwerk in einen Mangelschaden, einen Folgeschaden, einen Schaden verursacht durch Zufall und einen Begleitschaden zu unterteilen. Über die Abwicklung dieser Schäden werden in Österreich im Allgemeinen Bürgerlichen Gesetzbuch Regelungen getroffen, welche sich vor Übernahme der Leistung durch den Auftraggeber für zuordenbare Schäden aus dem Schadenersatzrecht und für Schäden verursacht durch Zufall aus dem Gefahrtragungsrecht ergeben. Ebenso ist im Hinblick auf die Abwicklung von Mängeln das Recht des Auftraggebers auf Vertragserfüllung zu beachten. Die im Bauwesen in Österreich häufig als Vertragsgrundlage verwendete ÖNORM B 2110 sieht ebenfalls von der Gesetzeslage abweichende Regelungen vor, die eine unterschiedliche Risikoverteilung für den Auftragnehmer und den Auftraggeber bewirken. Vor allem für die Abwicklung von nicht zuordenbaren Begleitschäden fehlt im österreichischen Zivilrecht, dem ABGB, eine für einen geordneten und konfliktfreien Bauablauf notwendige, klare Vorgangsweise. Die ÖNORM B 2110 hat im Punkt 12.4 mit der "Bauschadensregelung" eine solche Abwicklung getroffen. Ebenso gibt es mit der in der Schweiz häufig angewendeten SIA 118 Art.31 und auch freiformulierten Vertragsbedingungen weitere sinnvolle Regelungen zur Abwicklung. Aus den begutachteten Normen und frei formulierten Vertragsbedingungen ergeben sich, aufbauend auf der ÖNORM B 2110 Pkt.12.4, folgende sinnvolle Regelungen des nicht zuordenbaren Bauschadens aus Sicht des Auftraggebers: Für den AG macht eine Anhebung oder sogar Aufhebung der Haftungsobergrenzen der einzelnen AN aus der ÖNORM B 2110 Pkt.12.4 (lt. ÖNORM 0,5%) bei nicht zuordenbaren Bauschäden Sinn, um das Risiko einer Haftung im Falle nicht zuordenbarer Bauschäden zu minimieren. Seite II von VIII Ein vorzeitiger Einbehalt eines Teiles der Abrechnungssumme als "Deckungsrücklass für Bauschäden" ist für den AG empfehlenswert, um eine Deckung der Schadenssumme der nicht zuordenbaren Bauschäden der einzelnen AN auf jeden Fall zu gewährleisten. Um eine einfache Abwicklung der nicht zuordenbaren Bauschäden für den AG, vor allem bei Einzelgewerkvergabe, zu ermöglichen, kann anstatt der ÖNORM B 2110 Pkt.12.4 ein Pauschalabzug für nicht zuordenbare Bauschäden mit den AN vereinbart werden. Für den AN ergeben sich aus der Analyse der ÖNORM B 2110 Pkt.12.4, sowie der schweizerischen SIA 118 Art.31 und ausgewählten frei formulierten Vertragsbedingungen folgende vorteilhafte Regelungen: Ein Anheben der Haftungsobergrenze kann unter Umständen auch von Vorteil für die AN sein. Bei hohen Schadenssummen an ihren eigenen Leistungen und einer Überschreitung der Haftungsobergrenze einzelner anderer AN geht ein Anteil der Kosten für die Behebung zu Lasten des geschädigten AN. Sollte die ÖNORM B 2110 Pkt.12.4 vereinbart werden, ist eine Abänderung der Berechnungsgrundlage von der ursprünglichen Auftragssumme auf die tatsächliche Abrechnungssumme nach SIA 118 Art.31 für den AN von "Vorteil". Da dies m.E. nach jedoch nicht praktikabel ist, sollte seitens des AG die Auftragssumme samt Nachträge als Berechnungsgrundlage herangezogen werden. Die ist ebenfalls eine "faire" Lösung für alle haftenden AN und spiegelt die tatsächlich erbrachte Leistung wieder. Im Falle eines möglichen Freibeweises eines der AN ist die Regelung nach der SIA 118 Art.31 für AN von Vorteil. Hier erhöht sich im Gegensatz zur ÖNORM B 2110 nicht die Haftungssumme der verbleibenden AN, sondern der AG übernimmt den Haftungsanteil des AN der sich entlastet hat. Der AN sollte die Möglichkeit bekommen eine Bankgarantie für den "Deckungsrücklass für Bauschäden" zu legen. Um eine für alle Vertragsparteien faire Abwicklung zu vereinbaren sollten bei der Vertragserstellung sowohl Vorteile des AN als auch des AG im Hinblick auf die Abwicklung des nicht zuordenbaren Bauschadens berücksichtigt werden. Auf jeden Fall ist eine Regelung für die Abwicklung des nicht zuordenbaren Bauschadens vorzusehen, um Streitigkeiten der am Bau Beteiligten während der Bauausführung zu minimieren.

During a construction project, damage to the building structure can hardly be avoided. For that reason, it is essential to agree in a contract which party is liable for any damage during the construction. The damage to the building structure can have different causes. For example, a damage to a structure is distinguished into a defect, a consequential damage, a damage caused by chance or a collateral damage. On this subject regulations in Austria are written down in the general civil code. However, the so called ÖNORM B 2110, which is often used as the basis for contracting, provides regulations deviating from the legal situation. This results a different risk distribution for the employer and the contractor. One fundamental regulation, that is missing in the Austria civil law, is, how to deal in a case of a non-attributable structural damage. The ÖNORM B 2110 provides a nonideal regulation in point 12.4, the so called "Bauschadensregelung". With the SIA 118 Art. 31 frequently applied in Switzerland and free-formulated contractual conditions there are further meaningful regulations for a settlement. Based on the ÖNORM B 2110 Pkt.12.4, the following meaningful regulations of nonattributable structural damage arise from the assessed standards and freely formulated contract conditions from the point of view of the employer: For the employer, raising or even cancelling the liability limits of the contractors from ÖNORM B 2110 Pkt.12.4 (according to ÖNORM 0.5%) for non-attributable structural damage makes sense to minimize the risk of liability in case of non-attributable structural damage. A premature withholding of a portion of the settlement amount as "retention for structural damage" is recommended for the employer in order to ensure coverage of the damage amount of the non-attributable structural damage of the contactors in any case. In order to facilitate a simple handling of the non-attributable structural damage for the employer, a lump-sum deduction for non-attributable structural damage can be agreed with the contractor instead of the ÖNORM B 2110 Pkt.12.4. Seite IV von VIII From the analysis of ÖNORM B 2110 Pkt.12.4, as well as the Swiss SIA 118 Art.31 and selected freely formulated contractual conditions, the following advantageous regulations result for the contractor: Increasing the liability limits may also be beneficial to the contractor. In case of large sums of damage to their own services and exceeding the liability limit of other contractors, a share of the repair costs will be borne by the injured party. If the ÖNORM B 2110 Pkt.12.4 is agreed upon, a change of the calculation basis from the original order sum to the actual settlement sum according to SIA 118 Art. This is a "fair" solution for all liable contractors and reflects the actual performance provided. In the case of a possible free evidence of one of the contractors, the regulation according to the SIA 118 Art. 31 is advantageous for the contractor. In contrast to the ÖNORM B 2110 the liability sum of the remaining contractors does not increase. The employer assumes the liability of this contractor. The contractor should have the possibility to provide a bank guarantee for the "retention for structural damage". In order to arrange a fair settlement for all contracting parties, both advantages of the contractor and the employer with regard to the handling of the non non-attributable structural damage should be taken into account when the contract is made. In any case, regulations should be made for the settlement of the non-attributable structural damage.
