Abstract:
Diese Diplomarbeit versucht den gegenwärtigen Diskurs aufzugreifen und untersucht die Ursachen und Auswirkungen von unterschiedlichen sich aus der (Boden-) Preissteigerung ergebenden Problemen und der Zurückdrängung von leistbarem urbanem Wohnraum. Als ein Lösungsweg wird die städtische Bodenpolitik gesehen, wobei der Frage nachgegangen wird, welche bodenpolitischen Ziele die Stadt Wien verfolgt und wie versucht wird diese Ziele zu erreichen. Weiters wird untersucht, welche unterschiedlichen Instrumenten ihr zur Verfügung stehen, um in das Marktgeschehen einzugreifen, was meist unvermeidbar mit einem Eingriff in das private Grundeigentum oder die Interessen der unterschiedlichen Grundstückseigentümer verbunden ist. In einem ersten Schritt wird der Begriff des Grundeigentums von rechtlicher, sowie immobilienwirtschaftlicher Sicht beleuchtet, wobei auch die theoretische Systematik der Bodenpreisbildung näher betrachtet wird. Hinzukommend werden die sich, aus dem Wesen des Immobilienmarktes ergebenden Probleme, wie die Finanzialisierung des Wohnraums, Spekulation oder Verdrängungseffekte und steigende Hindernisse für sozialen Wohnbau angeführt. Es zeigt sich, dass ein Eingreifen in den Markt aus sozialpolitischen Gründen notwendig erscheint. Die Ergebnisse der Arbeit verdeutlichen, dass Wien einen breiten bodenpolitischen Zielkatalog aufgestellt hat und viele festgelegte Ziele vor allem im Zuge von neuen Widmungsverfahren umgesetzt werden können. Insbesondere wird in Wien der Mechanismus durch ein Zusammenspiel von planungsrechtlichen, konsensualen und marktkonformen Instrumenten charakterisiert. Die erfolgreiche Schaffung von leistbarem Wohnraum ist meist vorrangig mit privatrechtlichen Verträgen verbunden, welche im Zuge von Projektentwicklungen ausgehandelt werden. Hierbei konnte eine gewisse Interventionslogik identifiziert werden, die die hohe Relevanz des vertraglichen Instruments verdeutlicht. Der sogenannte Städtebauliche Vertrag nach §1a der Wiener Bauordnung ermöglicht der Stadt im Kontext mit den festgesetzten Planungszielen eine Quote an geförderten Wohnungen zu vereinbaren bzw. gewisse Bauplätze an städtische oder gemeinnützige Gesellschaften zu übertragen. Bei der Analyse wird jedoch auch deutlich, dass der Stadt Grenzen der Beeinflussbarkeit gesetzt sind, da der Einfluss auf Grundeigentümer mit bestehender Baulandwidmung oder ohne Umwidmungserfordernis, rechtlich sehr stark beschränkt ist. In Wien wird somit gerne ein „konsensualer“ und kooperativer Weg des Aushandelns vorgezogen, um die Ziele der Stadt erfolgreich umsetzen zu können. Schlussendlich hat sich gezeigt, dass diese Verfahren ein sehr langwieriger Prozess sind und es zukünftig mehr Standardisierung braucht, welche von Seiten der Immobilienwirtschaft eingefordert wird und in Wien noch nicht erkennbar ist.

This diploma thesis tries to pick up the current discourse and investigates the causes and effects of different problems resulting from (land-) price increase and the reduction of affordable urban housing. Urban land policy is seen as a solution, whereby the question is pursued, which ground policy aims the city of Vienna pursues and how it attempts to reach these aims. Furthermore, the various instruments available to intervene in the market, which is usually unavoidably associated with an interference in private land ownership or the interests of different landlords. In a first step, the term of land ownership is examined from a legal as well as real estate economic point of view, whereby the theoretical systematics of land price formation is considered in more detail. In addition, the problems arising from the nature of the real estate market, such as the financialization of housing, speculation, or land crowding and increasing obstacles to social housing, are cited, showing that intervention in the market seems necessary for social-political reasons. The results of the thesis show that Vienna has set a broad policy target catalog and that a lot of set aims mainly can be implemented in the course of new land planning procedures. It shows that in Vienna the mechanism is characterized by an interplay of planning law, consensual and market conform instruments. The successful creation of affordable housing is usually connected with private law contracts, which are negotiated in the course of project developments. Here a certain intervention logic was identified, that shows the relevance of this instrument. The so-called urban development contract according to §1a of the Vienna Building Code allows the city in the context of the planning aims to agree a quota of subsidized housing or transfer certain building sites to municipal or non-profit companies. During the analysis, it also becomes clear that the city has limits of influenceability, since the influence on land owners with existing building land use or without the need of another plan, is very limited in law. In Vienna, therefore, a "consensual" and cooperative way of negotiating is primarily preferred in order to be able to successfully implement the aims of the city. The process itself takes a lot of time and will need better standardization in the future. Which is demanded by the real estate industry and is not yet recognizable in Vienna.
