Major mergers and acquisitions during the past decade involved multinational companies, and both continents, Europe and South America, were highly affected by such mergers. The goal of this study is to analyze and compare European and Brazilian Merger Control legislation in order to understand their differences and similarities, and how they impacted some transcontinental mergers on the past decade. On the first part of this study, Chapter I focused on the legal background of Brazilian and European Merger Control law, highlighting the legislation, jurisdiction, thresholds, enforcement agencies, notifications, requirements, clearance timetable, assessments criteria, remedies and ancillary restrains, judicial review, enforcement practice and future development. The second part, Chapter II, shall be the substantive part of this study, focused on the comparisons of 6 merger cases which were notified to both European Commission and Brazilian Merger Control Agency, comparing mainly the market definition, economic methodology, how European Commission and Brazilian Merger Control Agency valued the economic facts in terms of legal assessment, as well as the conclusion and remedies suggested by each of the respective Agency.
