Copyright aspects concerning the Pirate Bay trial in Sweden and its influence on an international level

Abstract

Neueste Technologien ermöglichen es mittels File Sharing urheberrechtlich geschütztes Material, wie beispielsweiseMusik, Filme, Spiele oder Software zu vervielfältigen und global zu verteilen. Der Downloadprozess kann bereits durch wenige Klicks initiiert werden. Dies hat für Benutzer und Anbieter, rechtlich gesehen, unterschiedliche Folgen, einerseits kann ein Benutzer oder ein Anbieter wegen Urheberrechtsverletzungen oder Beihilfe zu Urheberrechtsverletzungen strafrechtlich verfolgt werden.<br />Wegen derartiger Vergehen gibt es laufend Prozesse, der Aspekt einheitlicher Strafen auf internationaler Ebene sowie die Frage, wer für die Urheberrechtsverletzung haftet, steht immer noch im Diskurs.<br />Aspekte dieser Diskussionen, ausgelöst durch den Pirate Bay-Prozess, werden in dieser Arbeit behandelt. Das erstinstanzliche Urteil hat diesen Diskussionen zu einem breiteren medialen Interesse verholfen. Dieser Prozess bildet die Grundlage für alle weiteren Aussagen dieser Arbeit. Das im April 2009 verkündete Urteil wird analysiert und gleichzeitig gilt es existierende Schwachstellen unserer Urheberrechtssysteme undmögliche Einflüsse auf internationaler Ebene zu finden. Grundlage für eine genaue Analyse bildet der technische Hintergrund von File-Sharing.<br />Im Prozess wurde auch auf relevante internationale Rechstinstrumente zurückgegriffen, wie EU-Richtlinien oder die Abkommen der Weltorganisation für geistiges Eigentum (WIPO). Neben der Europäischen Union (EU) hat dieWelthandelsorganisation (WTO) eine wichtige Rolle als eine der treibenden Internationalen Organisationen rund um den Schutz von geistigem Eigentum. Auf politischer Ebene verzeichneten die Pirate Party und deren Parteiprogramm nicht nur in Schweden Erfolge.<br />Die genannten Kritikpunkte sollen zu möglichen Alternativen zum Schutz von geistigem Eigentum und Lösungsvorschlägen führen, wie beispielsweise neuen Formen von Lizenzen. Es werden bereits bestehende und neue Geschäftsmodelle sowie Preismodelle rund um das Thema Urheberrechtsschutz im Internet dargelegt und diskutiert.<br />

The almost unlimited opportunities of the World Wide Web (WWW) have not only a positive impact on the users. The use of this technology has made copyright infringement an everyday business. The possibilities for downloading music, movies, games and software are very tempting. Just by making a few clicks the downloading process is initiated.<br />This thesis deals with issues of copyright infringement in connection to the latest discussions about the Pirate Bay trial. Because of the outcome of the trial in April 2009 in Sweden this work criticises existing aspects of copyright systems in general. Therefore, an analysis of the trial and its first verdicts is made. Furthermore, the technical background of file sharing is touched upon. The trial itself has a significant influence on international copyright laws.<br />The European Union (EU) tries to support member states by developing directives concerning copyright and intellectual property rights. The directives force the current legislator in Austria and Sweden as well as other countries to reconsider and adjust parts of the national copyright law.<br />Moreover, relevant international treaties and their initiators like the World Intellectual PropertyOrganization (WIPO) and theWorld TradeOrganization (WTO) and their roles are mentioned. Regarding impacts on a political level the Pirate Party, its programme and its latest success in the EU elections 2009 are presented.<br />These developments force us to think about new ways to ensure that creative products and works by artists are protected but do not remain in copyright. Additionally, the concept of intellectual property is discussed within this thesis.<br />An examination of all these aspects is supposed to lead to new approaches and possible solutions like new forms of licenses. Besides, existing business models and pricingmodels for the protection of works likemusic,movies, games, and software by copyright are listed.
