Abstract:
Heutzutage spielt Cloud Computing in der Informationstechnologie eine sehr wichtige Rolle. Viele Unternehmen möchten Ressourcen flexibler und effizienter einsetzen und dabei ihre Kosten senken. Um dies zu erreichen, ermöglicht Cloud Computing, den Betrieb von Anwendungen oder Infrastruktur (z.B. Rechenleistung, Speicherkapazität, usw.) an außenstehende Anbieter auszulagern.Im Zusammenhang mit diesen Dienstleistungen bringt Cloud Computing zahlreiche Problemstellungen im Bereich des Vertrags- und Datenschutzrechtes mit sich, die in dieser Arbeit näher diskutiert werden.Speziell das Löschen von Daten stellt eine Herausforderung dar, weil dieses nicht umfassend rechtlich geregelt und auch die technische Umsetzung problematisch ist. Der Schwerpunkt dieser Arbeit liegt daher in einer Betrachtung des Rechts auf das Löschen von Daten in der Cloud. Es werden existierende rechtliche Grundlagen sowie ein neuer Ansatz das „Recht auf Vergessenwerden“ erläutert. In diesem Zusammenhang werden die Erkenntnisse aus rechtlicher und technischer Sicht zusammengefasst und ein Ausblick gegeben, wie das Recht auf Vergessenwerden rechtlich und technisch umgesetzt werden könnte.

Nowadays, cloud computing plays a very important role in information technology. Many companies would like to use resources more flexible and efficient while reducing their costs. To achieve this, cloud computing enables the operation of applications or infrastructure (e.g. computing power, storage capacity, etc.) to be outsourced to external providers.In connection with these services, cloud computing brings numerous problems in the contract and data protection law with it, which are discussed in more detail in this work.Particularly, the deletion of data is a challenge because it is not comprehensively regulated, and the technical implementation is problematic as well. The focus of this work lies on a consideration of the right to delete data in the cloud. Existing legal principles and a new approach, the “right to be forgotten”, are explained. In this context, the findings are summarized from a legal and technical point of view and an outlook is given of how the right to be forgotten could be implemented legally and technically.
