Diese Arbeit beschäftigt sich mit der Frage, wie sich die durchschnittlichen Mietpreise in den Metropolen Wien und Berlin in den letzten 10 Jahren in Abhängigkeit der jeweiligen Mietrechtsmodelle entwickelt haben. Vor dem Hintergrund steigender Mieten, insbesondere in den Hauptstädten, gewinnt die Frage nach Miethöhe und den Möglichkeiten, deren rasanten Anstieg zu begrenzen, zunehmend an Relevanz. Da der Mietpreis von vielen Faktoren beeinflusst wird, fußt diese Arbeit auf einer umfassenden Betrachtung der Rahmenbedingungen. In einem ersten Schritt wird das Mietrecht in den beiden Hauptstädten, vorwiegend hinsichtlich Mietpreisbildung, Mietzinsregulierung und Möglichkeiten der Mietpreisanpassung, beleuchtet. Anschließend werden neben allgemeinen Daten zum Wohnungsmarkt insbesondere jene Segmente herausgearbeitet, für die unterschiedliche Regelungen der Mietpreisbildung gelten. Hiernach werden die Mietpreise für die jeweiligen Teilsegmente sowie die Mietmärkte allgemein für den Zeitraum 2012 bis 2022 erhoben. Im zentralen Kapitel der Arbeit werden diese Preise zueinander, aber auch im Verhältnis zu anderen Indikatoren wie Verbraucherpreisindizes, Bevölkerungswachstum und Angebotsentwicklung betrachtet. Basierend auf diesen Analysen kann die Forschungsfrage: „Führen die unterschiedlichen Mietrechtsmodelle in Berlin und Wien zu einer unterschiedlichen Mietpreisentwicklung in den letzten 10 Jahren?“, wie folgt beantwortet werden: Innerhalb der Mietrechtssegmente, die einer speziellen Regulierung unterliegen, kann festgestellt werden, dass sich diese Regulierung zumindest in Wien stark dämpfend auf die Entwicklung der Miethöhe auswirkt. Darüber hinaus zeigt sich in beiden Mietmärkten, dass es Kompensationseffekte gibt, wenn das Verhältnis aus Angebot und Nachfrage aus dem Lot gerät. In Wien zeigt sich dieser Kompensationseffekt durch einen überdurchschnittlichen Anstieg der nicht regulierten Mieten. In Berlin lassen die Angebotspreise darauf schließen, dass Ausnahmeregelungen intensiv genutzt werden, aber vermutlich auch die Preisbegrenzung durch die ortsübliche Vergleichsmiete auf verschiedene Weisen umgangen wird.
