Handlungsempfehlungen für den Einsatz von kooperativen Vertragselementen in Kombination mit der BIM-Methodik

Abstract

Die vorliegende Diplomarbeit beschäftigt sich mit dem Einsatz kooperativer Vertragselemente im Zusammenhang mit der Anwendung von Building Information Modeling (BIM) in Bauprojekten. Das Ziel ist es, Herausforderungen und Lösungsansätze für eine effiziente Zusammenarbeit der Projektbeteiligten zu identifizieren. Darüberhinausgehend sollen Handlungsempfehlungen für eine optimale Nutzung des vertraglichen Potenzials gegeben werden. Zunächst werden die rechtlichen Rahmenbedingungen in Österreich beleuchtet. Im Speziellen werden das Allgemeine Bürgerliche Gesetzbuch (ABGB), das Bundesvergabegesetz (BVerG) und die relevanten ÖNORMEN wie B 2110 und B 2118 dargestellt. Darauf aufbauend werden traditionelle Projektabwicklungs-Strukturen wie Einzelvergabe, Generalunternehmer und Totalunternehmer analysiert. Im Detail wird auf kooperative Abwicklungsmodelle wie Early Contractor Involvement, Construction Management und Value Engineering sowie auf die kooperativen Vertragsmodelle wie PPC2000, Zielkostenvereinbarungen und Project Alliancing eingegangen. Ein wesentlicher Fokus der Arbeit liegt auf dem Zusammenspiel von vertraglichen Aspekten und Abwicklungskonzepten mit BIM. Dazu werden die Grundlagen, Arten, Reifegrade und Detaillierungsgrade von BIM betrachtet. In weiterer Folge werden die Prozesse, Richtlinien, Rollen und Werkzeuge im BIM-Kontext diskutiert. Zur Identifikation von Problemfeldern und Best Practices wurden Experteninterviews mit Vertretern verschiedener Projektbeteiligter (Planer, Ausführende, Bauauftraggeber, Juristen, Hersteller, Berater) durchgeführt und ausgewertet. Eine wesentliche Informationsquelle waren auch die Workshops zum Thema "Zusammenarbeit mit BIM", die im Rahmen des gleichnamigen Pionierprojektes von Digital Findet Stadt durchgeführt wurden. Als zentrale Herausforderungen bei der Kombination von kooperativen Vertragselementen und BIM wurden unter anderem die mangelnde Einbindung von Ausführungs-Know-how in frühen Projektphasen, unzureichende vertragliche BIM-Regelungen, fehlende einheitliche BIM-Standards, Schwierigkeiten bei der Umsetzung kooperativer Vertragsmodelle und mangelnde Risikobereitschaft identifiziert. Die vorgestellten Lösungsansätze umfassen die frühzeitige Einbindung aller Projektbeteiligten, gemeinsame Zieldefinition und Kostendeckelung, Transparenz durch Open-Book-Prinzip, effizientes Änderungs- und Nachtragsmanagement, Anreizmechanismen für kooperatives Verhalten sowie Partnering und Mediation. Darauf basierend wurden Handlungsempfehlungen zur Ausschöpfung von vertraglichen Potenzialen formuliert. Diese wären die sorgfältige Analyse von Projektspezifika bei der Vertragsauswahl, die Schaffung einer kooperativen Projektkultur, klare Regelungen zu BIM-Prozessen und Verantwortlichkeiten sowie die Etablierung von Konfliktlösungsmechanismen und Anreizsystemen beinhalten. Zuletzt wird ein Ausblick auf weiteren Forschungsbedarf gegeben, um die Potenziale kooperativer Vertragselemente und von BIM in Bauprojekten zukünftig noch besser ausschöpfen zu können.

This thesis examines the use of collaborative contract elements in the context of Building Information Modeling (BIM) and the implementation of these elements in construction projects. The objective of this research is to identify challenges and solutions for the efficient collaboration between project participants. Furthermore, recommendations are given for the optimal use of the contractual potential. First, the legal framework in Austria is examined. In particular, the General Civil Code (ABGB), the Federal Procurement Act (BVerG) and the relevant ÖNORM standards such as B 2110 and B 2118 are presented. Based on this, traditional project management structures such as individual awards, general contractors and total contractors are analyzed. Furthermore, cooperative delivery models such as early contractor involvement, construction management and value engineering as well as cooperative contract models such as PPC2000, target cost agreements and project alliances are discussed in detail. The primary objective of this research is to examine of the relationship between contractual aspects and the execution concepts with BIM. In particular, the fundamentals, types, maturity and level of detail of BIM are examined. This is followed by a discussion of processes, guidelines, roles and tools in the context of BIM. To identify problem areas and best practices, expert interviews were conducted and evaluated with representatives of various project participants (designers, contractors, owners, lawyers, manufacturers, consultants). Furthermore, the "Collaboration with BIM" workshops, which are part of the pioneering Digital Findet Stadt project, are a valuable source of information. The key challenges identified in the integration of collaborative contracting and BIM were the lack of integration of construction expertise in early project phases, inadequate contractual BIM provisions, a lack of uniform BIM standards, difficulties in implementing collaborative contracting models, and a lack of willingness to take risks. The solutions presented include early involvement of all project participants, joint target definition and cost capping, transparency through the open-book principle, efficient change and addendum management, incentive mechanisms for cooperative behavior, and partnering and mediation. Based on these considerations, recommendations for action were formulated to exploit the contractual potential. These include a careful analysis of project specifics when selecting contracts, the creation of a collaborative project culture, clearly defining BIM processes and responsibilities, and establishing conflict resolution mechanisms and incentive systems. The paper concludes with a discussion of the necessity for further research to more effectively exploit the potential of collaborative contracting and BIM in construction projects in the future.
