Abstract:
In der Diplomarbeit wird die rechtliche Situation, in Bezug auf die Neuorientierung der Abfallwirtschaft, untersucht. Im Rahmen der rechtlichen Grundlagen wird auf jene Gesetze, Verordnungen, ÖNORMEN und Richtlinien eingegangen, die im Rahmen der gesetzlichen Auflagen zu erfüllen oder einzuhalten sind. Weiters werden die technischen Grundlagen für die Sammlung und für die Entsorgung von Baurestmassen im Straßenbau untersucht, sowie auf die unterschiedliche Klassifikation von Baurestmassen eingegangen. Weiters wird ein Entsorgungskonzept an Hand einer Abbildung beschrieben. Ein Bereich dieser Diplomarbeit beschäftigt sich auch mit dem Baustoff Recycling.<br />Der Entsorgungspflichtige von Baurestmassen sollte wissen, dass die Abfallverwertung Vorrang vor der sonstigen Entsorgung hat, wenn sie technisch möglich ist. Die hierbei entstehenden Mehrkosten sind im Vergleich zu anderen Verfahren der Entsorgung nicht unzumutbar und für die gewonnenen Stoffe ist ein Markt vorhanden. Diese Voraussetzungen dürften erfüllt sein, wenn es um die Frage geht, ob die Baurestmassen sinnlos auf Deponien vergeudet oder besser sinnvoll verwertet werden sollen.<br />·Baustoffrecycling ist technisch gelöst, die Aufbereitungstechnologie ist hoch entwickelt, lediglich Einzelverbesserungen der Aggregate etwa im Bereich der Verschleißminderung bei Brechern können den technischen Standard noch weiter anheben.<br />·Baustoffrecycling ist volkswirtschaftlich notwendig, um die immer knapper und kostspieliger werdenden Deponien zu entlasten, Rohstoffreserven zu schonen und Materialtransporte zu reduzieren.<br />·Baustoffrecycling ist betriebswirtschaftlich rentabel, wenn eine genaue Analyse vor Ort erfolgt über Art und Umfang des Materialaufkommens und Materialabsatzchancen.<br />·Baustoffrecycling leistet einen entscheidenden Beitrag zu ökonomisch und ökologisch intelligenten Materialkreislauf vor allem dort, wo Landesbehörden ihre politisch verantwortliche Rolle zur Unterstützung dieses Kreislaufprozesses wahrnehmen.<br />Auch wenn aufgrund der fehlenden Aufzeichnungen für Österreich im Überblick keine Daten zur Verwertung vorhanden sind und auch die Verwertungsquoten regional unterschiedlich sind, so kann angenommen werden, dass der "kalte Verwertungsweg" von Straßenaufbruch gerade in den letzten Jahren eine überragende Bedeutung eingenommen hat. Die Verwertungsquote liegt zwischen 70 und 90%. Derzeit wird praktisch nur jener Anteil von Altasphalt deponiert, der aufgrund der besonderen örtlichen Gegebenheiten des Straßenaufbaues oder auch durch die Unzugänglichkeiten beim Aufbruch zwangsweise nicht sortenrein gewonnen werden kann.<br />

This master thesis shows up the legal situation in Austria with regard to the new orientation in waste management. The focus is set to those laws, regulations, Austrian standards and guidelines which have to be fulfilled and observed. Instructions for collection and disposal of the residual waste in road construction are analysed and the different classifications described. A concept for waste disposal is explained on an illustration. The thesis also deals with the recycling of building material.<br />The responsible person for building material residues should be aware of the fact that waste recycling, provided it is technically feasible, has priority over any method of mere waste disposal. The additional costs for recycling in order to other forms of waste management are acceptable and there is a market for recycled products. There can be no doubt that it is better to recycle than to simply dump the waste into a landfill.<br />·Recycling of building materials has been solved from the technical point of view. The treatment technology has a high level of development.<br />Further raise of the technical standard would be some minor improvements of the aggregates, such as minimising wear and tear in crashers.<br />·Recycling of building materials is economically necessary in order to relieve the landfills of which there is already a shortage and which become more and more expensive. Moreover, resources have to be handled sparingly and transportation has to be reduced.<br />·From the business management standpoint recycling of building materials is profitable, after an exact analysis about the type and volume of material which can be expected.<br />·Recycling of building materials makes an important economical and ecological contribution to an intelligent circulation of materials, particularly in those places where the local authorities support such endeavours as part of their political responsibility.<br />In Austria there are no overall records about the masses of waste material coming from road construction sites available and the recycling rate differs regionally. It can be assumed that the "Cold Recycling" of rubble in road construction has gained considerable in the last few years. The recycling rate lies between 70 and 90 %. At present only the part of asphalt waste is put into landfills which cannot be separated and graded because of the local road conditions or some imperfections in the course of the demolition working process.<br />
